Ray Moore and Cordes Kennedy worked together to obtain a rare Rule 12(b)(6) dismissal in April for a landlord who was sued after a fatal shooting in a residential mobile home park. Ray and Cordes argued that there was no set of facts in which a residential landlord could have been liable when one of its tenants accidentally shot and killed a visiting friend. Despite the high standard for dismissal under Rule 12(b)(6) of the South Carolina Rules of Civil Procedure, the Court dismissed the case. The dismissal was not appealed.
