Two recent cases resulted in favorable rulings for Founder and Managing Shareholder J.R. Murphy. Partner Megan Walker and Associate Will Arnold wrote excellent briefs that proved to be invaluable as both cases were decided without live argument. Megan’s assistance helped to secure a favorable ruling from the South Carolina Court of Appeals. The appeal stemmed from the denial of post-judgment interest in a declaratory judgment action that was originally decided by the trial court in 2016. In a Per Curiam decision the appeals court affirmed stating a declaratory judgment is not a money judgment subject to statutory interest.
In the second case, summary judgment was granted on a homeowner’s property damage claim in United States District Court, Columbia Division, prevailing upon policy exclusions for damage caused by corrosion and/or long term water leakage.
